General conditions of participation for competitions on Facebook and Instagram

organises competitions at irregular intervals on the Facebook Page und Instagram Page at Grazer Winterwelt through.
Purposes of the processing
We process your data for the purpose of your participation and processing of our competitions. In this context, your data will be processed as follows:
• Creation of a list of participants and winners
• Transmission of your data to cooperation partners in connection with the prize to be raffled
• Transmission of the prize to you
Data processing for advertising purposes
Subject to your express consent, the data provided by you in the course of the competition will be used to send information material on products and services of the companies of FSM Veranstaltungen GmbH (see in detail under “Recipients of the data”). You have the right to object to the processing of your data for advertising purposes at any time by e-mail to presse@grazerwinterwelt.at or by post at FSM Veranstaltungen GmbH, Firmenkommunikation, Koschatgasse 28, 8020 Graz to revoke.
Legal basis for data processing
By participating in the competition, we conclude a so-called contract of happiness with you. Your data is therefore processed on the basis of this contract with us (Art. 6 Abs. 1 lit. b DSGVO). If you do not provide us with the data, we will not be able to fulfil our contractual obligations. You would therefore not be able to take part in the competition.
If you are the FSM Veranstaltungen GmbH and other companies, see in detail under “Recipients of the data”, your data is also made available for the purpose of sending information material on products and services, this data processing is authorised by your consent. (Art. 6 Abs. 1 lit. a DSGVO) justified.
Recipient of the data
Your data will be disclosed to the following recipients in connection with the respective game of chance:
Kooperation partner of the competition, which is indicated as a sponsor partner in the respective Facebook or Instagram post. Since 1 December 2024, this includes the following partners:

• Antenne Steiermark Regionalradio GmbH & Co KG, Gadollaplatz 1, 8010 Graz
• Planaibahnen, Coburgstraße 52, 8970 Schladming
• Tourismusverband Region Graz, Messeplatz 1, 8010 Graz
• GRAWE, Herrengasse 18-20, 8010 Graz
• Energie Graz, GmbH & Co KG Schönaugürtel 65, 8010 Graz
Meta Platforms Ireland Limited (Facebook, Instagram) based in 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland as a processing platform. We do not actively transmit any data to Meta.
Storage of the data
The data of all participants will be deleted no later than 3 years after the end of the competition (§1489 ABGB). The data of winners will be deleted for the duration of the statutory retention periods, in particular the Federal Fiscal Code, i.e. after 10 years from the end of the year in which the competition takes place.
Rights of data subjects
We would also like to inform you that you have the right to request information about which of your data we process at any time (see in detail Art 15 DSGVO), have the right to have your data rectified or erased (see in detail Art 16 DSGVO), have the right to restrict the processing of your data (see in detail Art 18 DSGVO), have the right to object to data processing (see in detail Art 21 DSGVO) and the right to data portability (see in detail Art 20 DSGVO).

You can address complaints to the supervisory authority (usually the Austrian Data Protection Authority).

Participation in Facebook and Instagram competitions
Natural persons over the age of 18 are eligible to participate. All persons who complete the required action (usually a comment on Facebook and Instagram) as part of the competition during the specified period will be entered into the prize draw.
The winners will be chosen at random within 7 days of the end of the competition. The winners will be informed via a private message on Facebook or Instagram. If a winner does not respond, no prize will be transferred. The person responsible for the competition reserves the right to cancel the competition in justified cases, to postpone the determination of the winner or to change the course of the competition without giving reasons. Furthermore, no written or verbal information can be provided about the progress of the competition; your right to information within the meaning of the Art. 15 DSGVO is not affected by this. The prizes cannot be redeemed in cash. The competitions are in no way connected to Facebook or Instagram and are in no way sponsored, supported or organised by Facebook or Instagram. All questions, comments or complaints about the competitions should be directed exclusively to the FSM Veranstaltungen GmbH and not to Facebook or Instagram. The FSM Veranstaltungen GmbH indemnifies Facebook or Instagram against all liability claims in relation to the competitions organised.
